The Supreme Court held that where serious allegations indicate misuse of the IBC framework through asset undervaluation, collusive insolvency processes, and potential bank complicity, the Court may exercise its constitutional and supervisory jurisdiction to scrutinise investigative conduct, mandate probes into lender collusion, and direct investigative agencies to submit status reports to prevent insolvency proceedings from being used as a façade to legitimise financial fraud.
