Supreme Court denies entertaining SLP when the High Court has left open the question of "unjust enrichment".


The Supreme Court Bench comprising Justices M.R. Shah and C.T. Ravikumar were hearing on Monday, Special Leave Petitions and denied to entertain these SLPs as the High Court has left open the question of "unjust enrichment" and no final adjudication/determination had taken place on unjust enrichment.


The SC Bench noted that the present special leave petitions cannot be entertained at this stage when the High Court has left the question of unjust enrichment open and no final adjudication/determination had taken place on unjust enrichment.


"However, as and when any issue/question of unjust enrichment is raised, it goes without saying that it may be open for the petitioner to defend/oppose the same and all the defences which may be available to the petitioner are left open and which may be considered and dealt with in accordance with law and on its own merits", the Supreme Court noted.


Special leave petitions were dismissed.
